Many individuals have a divided way of thinking on whether it must be fixed punishment for specific type of crime or it should be depend upon the situation of an offence to be taken into account when determining a punishment. I personally think it should be depend on the situation rather then fixed punishment.
In justice system there should be equality and fairness among fixed punishments to ensure that everyone is treated same despite their background and status, avoiding personal bias or inconsistency. There should be a clarity in punishments like what will be consequences if someone commits a crime and this provides sense of security towards human beings. For example, in the scenario of salman khan’s rash driving and hit and run case due to his background and fan following judical system given very less amount of punishment against offender and as well as avoided the justice for poor people. So efficiency must exists in the legal system to provide equal justice to everyone.
On the other hand, not all crimes are same, people may commit crime for various reasons like due to poverty vs stealing just for greed. Likewise some people deserves a 2nd chance especially young individuals can learn from their mistakes instead of sending them to prison there should be correctional centers to give them a 2nd chance. Additionally, more human looking at situation helps judges to give punishments that match crime and persons background.
In my opinion, before giving any specific or fixed punishments a justice system must check the facts as well as background to avoid personal bias because all crimes are not same as people thinks it totally depends on situations.
