Band 6+: Many people believe that having a fixed punishment for all crimes is more efficient. What are the advantages and disadvantages of having a fixed punishment?

It is argued that all crimes should be convicted with a fixed sanction to be more beneficial. This application brings back both the benefits and drawbacks, which will be discussed in this essay.

In terms of the upsides, it is such a fair and accessible way for everyone to be aware about the crime punishments. People generally find it difficult and incomprehensive when it comes to many sets of law, therefore, shortening them with a common punishment for each offence offers the community much easier and less effortful legislation to be acquainted with. If people adequately acknowledge law enforcement for all crimes, they will be more conscious of their action and its consequences, leading to a deterrent effect, which can contribute to the decrease of crime rate. Moreover, by enacting an invariant penalty, there are no longer any mass protests or discussions about the unfair or inappropriate verdict which is reached by the judges. As a matter of fact, arbiters, prosecutors and lawyers have to deal with the intense disagreement, both mentally and physically, from the defendant’s family. So the suggestion can help to unease these disturbances.

In regards to the downsides, due to the fact that there are tons of reasons for people to commit a criminal affair, setting up this kind of law is not thoroughly appropriate and it has to be sorted out with different levels of severity and motivation. For example, the offender who is stated to be a murder can be a manslaughter when he was forced to kill the victim as a last resort to defend, rather than initially having an illicit motive. So a fixed punishment turns out to be inequitable in every affairs, entailing harsh and inhumane judgments. In addition, because of an unchangeable punishment, it discourages and halts prisoners from participation in rehabilitation programmes or community service, which is basically a considerable determination to shorten their prison sentence. Therefore, offenders are less likely to be entertained, educated or given a sense of community and prefer to learn more crime strategies from their inmates, during their sentence, which can engage in reoffending.
